The training organization SCALA France, SIRET 92165489300012, whose head office is located at 28 rue de la Pompe, 75116 Paris, France, organizes and delivers professional training courses. Its activity as a training provider is registered with the Île-de-France DREETS under an activity declaration number. This registration does not imply government approval.
The Customer's signature of these General Terms and Conditions of Sale (hereinafter referred to as "GTCS") implies their full and unreserved acceptance. The GCS prevail over any other document of the Customer, and in particular over any general terms and conditions of purchase, except in the case of a framework agreement or specific commercial agreement made with the Customer. All other SCALA France documents, such as brochures and catalogs, are for information purposes only. The fact that SCALA France does not take advantage, at a given moment, of any of the present conditions, cannot be interpreted as a renunciation to take advantage of them at a later date.

Your registration will be taken into account upon receipt of the training agreement or contract and these GTC duly signed and stamped (if possible). For distance learning courses, it is the participant's responsibility to ensure that his or her computer equipment is correctly configured before the course and within the allotted time.
Cancellations must be made in writing. Substitutions of participants are permitted at any time, free of charge, provided that SCALA France is informed in writing and that the names and contact details of the substitute(s) are received no later than the day before the training session.
You can cancel a registration free of charge by informing SCALA France by registered letter with acknowledgement of receipt or by email with acknowledgement of receipt to chloe@scal-ia.frreceived no later than fourteen [14] calendar days before the training date.
In the event of cancellation received less than fourteen [14] calendar days before the course (or the first module for distance learning courses), the full registration fee is payable. Any course not attended or only partially attended is payable in full.
All prices are quoted exclusive of tax and will be increased by applicable duties and taxes. Our prices include the training course, the pedagogical documentation provided, and electronic files where applicable. Unless otherwise agreed, full payment must be made before the start of the course, in cash and without discount on receipt of invoice. In the case of payment by an OPCO, we must receive the financing agreement from your OPCO before the 1st day of training. If Scal-IA has not received the financing agreement, you will be invoiced for the full cost of the training. In the event of partial reimbursement by the OPCO, you will be invoiced directly for the part not reimbursed.
Any invoice not paid by the due date will automatically bear interest at the rate applied by the European Central Bank to its most recent refinancing operation, plus 10 (ten) points.
In the event of non-payment of a single invoice by its due date, all sums owed by the Customer will become immediately payable.
All invoices recovered by our legal departments will be subject to a penalty clause of 15 (fifteen)% of the amount due, which is non-reducible within the meaning of article 1231-5 of the French Civil Code.
4 - LIABILITY - INDEMNITIES
The employer, or as the case may be the participant, undertakes to take out and maintain, in anticipation of and for the duration of the training course, civil liability insurance covering bodily injury, material and immaterial damage, both direct and indirect, which may be caused by his actions or those of his employees to the detriment of SCALA FRANCE or the participants. The participant also undertakes to take out and maintain civil liability insurance, also designating SCALA FRANCE as the insured party for any prejudicial acts to third parties caused by the participant's employee, and containing a waiver of recourse clause, so that SCALA FRANCE cannot be sought or worried.
5 - RIGHT OF CONTROL OF THE INSTITUT NATIONAL DE LA CONSOMMATION
SCALA FRANCE reserves the right, if the number of participants in a training course is deemed insufficient from a pedagogical point of view, to cancel the course no later than fourteen [14] calendar days before the scheduled date.
SCALA FRANCE reserves the right to postpone the training course, modify the location or content of the program, or replace a trainer, should circumstances beyond its control oblige it to do so.

6 - INTELLECTUAL PROPERTY
In order to respect the intellectual property rights attached to the course materials or other teaching resources made available to training participants, the Customer may not reproduce, directly or indirectly, in whole or in part, adapting, modifying, translating, representing, marketing or distributing to members of its staff who are not participants in SCALA FRANCE training courses or to third parties, the said teaching aids and resources without the express, prior and written authorization of SCALA FRANCE or its assignees.
7 - DATA PROCESSING AND FREEDOMS
SCALA FRANCE undertakes to ensure that the collection and processing of your personal data, carried out from the www.scal-ia.fr website , complies with the French Data Protection Act No. 78-17 of January 6, 1978, as amended, relating to data processing, files and freedoms (known as the "Data Protection Act") and Regulation (EU) No. 2016/679 of April 27, 2016 known as the "General Data Protection Regulation" (or "GDPR").
This policy describes how SCALA FRANCE undertakes to collect, use and protect your personal data.

8 - APPLICABLE LAW - ATTRIBUTION OF JURISDICTION
The present agreement is governed by French law.
In the event of a dispute concerning the interpretation or execution of any of these provisions, and in the absence of an amicable agreement between the parties, the Commercial Court of the training organization's registered office shall have sole jurisdiction.
